GENERAL TERMS AND CONDITIONS

The owner of the online store www.velohunt.eu (hereinafter the e-store) is Pro Shop OÜ, registry code 11589289, located at Tallinn Pärnu mnt 139e/1, email address info@velohunt.ee, telephone number (+372) 5566 4566 (hereinafter the Seller).

The terms of sale apply to the purchase of goods from the e-store www.velohunt.ee and regulate all purchase and sale transactions executed between the Seller and the Buyer.

The Seller has the right to change or supplement the terms of sale at any time. All changes and additions shall take effect immediately upon their publication on the velohunt.ee website.

The Buyer has the opportunity to review the terms of sale via the velohunt.ee website at any time, and the Buyer agrees to the provisions set forth in these terms when making a purchase from the e-store.

In addition to what is covered in the terms of sale, the legal acts in force in the Republic of Estonia and the resulting rights and obligations apply when making a purchase from the e-store.

CONCLUSION OF CONTRACT

The sales contract between Pro Shop OÜ and the Buyer shall enter into force upon receipt of the payable amount to the Seller’s bank account.

PRODUCT PRICES AND FEATURES

All products sold in the e-store are categorized according to their features and specific application.

The prices of the products sold in the e-store are indicated next to the products. All prices are presented in euros and include Value-Added Tax (VAT). For discounted prices of campaign or clearance sale products, both the old price of the product (crossed out) and the discounted price are displayed on the product page.

The cost of the shipping service is added to the product price, which depends on the delivery method chosen by the Buyer and the size of their purchase amount. All shipping service prices are displayed to the Buyer when placing the order.

The description of product features is reflected next to the respective product in the e-store. The Seller does their best to ensure that the product page for each product contains a text describing the product features as accurately and thoroughly as possible. Product additional information is updated and supplemented regularly. If necessary, customer support will respond to the Buyer’s additional questions, striving to provide relevant recommendations based on the needs of each specific Buyer.

The Seller does its best to ensure the presence of an illustrative and as true-to-life product photo for all products. If the product significantly differs from the illustrative photo, corresponding additional information is reflected on the respective product page.

The Seller has the right to supplement and change product features and/or price information at any time. All changes and additions shall take effect immediately upon their publication on the velohunt.ee website. The Seller has no additional obligation to separately notify the Buyer of all changes and additions in writing.

In the event that product features and/or prices change after the Buyer confirms the order but before payment for the products, the product features and prices published on the velohunt.ee website at the time the Buyer confirmed the order shall apply to the Buyer for three calendar days from the confirmation of the order. If more than three calendar days have passed since the confirmation of the order and the Buyer has not made payment for the ordered products during that time, the changed prices shall apply to the Buyer.

The Seller has the right to withdraw from the purchase and sale transaction if the price reflected in the e-store differs significantly from the actual price due to an obvious human error or systemic technical error. In the case of small errors and differences, the product shall be sold to the Buyer at the price reflected in the e-store.

The Seller has the right to withdraw from the purchase and sale transaction if the product ordered by the Buyer is not in the Seller’s warehouse and the supplier has raised the price of that product without prior notice, whereby the product’s purchase price exceeds its sales price reflected on the velohunt.ee website. The Seller shall notify the Buyer of the price increase as soon as possible and offer the Buyer the best possible solution.

PRODUCT AVAILABILITY

The Seller does its best to ensure that the stock balance and delivery time indicated in the e-store correspond to reality. In the event that the stock balance is incorrect or the product sells out between the time the order is placed and paid for, the Buyer will be contacted as soon as possible. The Buyer will be notified of the extension of the delivery time and/or the option to choose alternative products with similar features. The Buyer will be offered the opportunity to replace the ordered product with another product of the same value or to receive a refund for the missing product.

PLACING AND PAYING FOR AN ORDER

To make a purchase from the velohunt.ee e-store, the Buyer must first select the appropriate products, paying attention to confirming the correct size and/or colour choice and quantity. The desired products are added to the shopping cart.

Adding a product to the shopping cart or confirming the order is not considered a reservation of the product, and the product remains available to other customers until the payment for it is received in the Seller’s bank account.

Before confirming the order, the Buyer checks whether all products entered in the shopping cart, their sizes, colours, and quantities correspond to what was desired.

To place the order, the Buyer fills in the requested data fields and selects a suitable delivery method for the products. In the case of sending to a parcel machine, the Buyer selects the exact desired parcel machine from the options displayed on the screen. In the case of courier delivery, the Buyer enters the precise delivery address.

The final sum for the products and delivery is displayed on the screen, which can be paid for by bank transfer, bank link, or credit card payment. When paying by bank transfer, the order number must be noted in the payment description. Bank link and credit card payments are mediated by LHV Paytech AS (EveryPay).

The sales contract between the Seller and the Buyer shall enter into force upon receipt of the payable amount to the Seller’s bank account.

DELIVERY

The Seller dispatches in-stock goods towards the destination indicated in the Buyer’s order within two working days from the receipt of the money to the Seller’s bank account. Domestic shipments within Estonia generally reach the destination specified by the Buyer within 2-4 working days from the entry into force of the sales contract.

During major campaigns and holidays (Black Friday, Cyber Monday, etc.), the arrival of goods may be delayed due to the heavy workload of logistics companies. Pro Shop OÜ is not responsible for delays caused by logistics companies.

If the product is not located in the Seller’s warehouse or the warehouse of their Estonian partner, this information is reflected in the product information, and the ordered product will reach the Buyer within the delivery time indicated in the product information.

In general, all products included in the order are sent out to the Buyer as a single shipment, and the order is dispatched at the moment when all products included in the order are available to the Seller.

If the dispatch of the order within the delivery time indicated in the product information is not successful, the Seller shall notify the Buyer of the extension of the delivery time as soon as possible via the email address or telephone number indicated in the Buyer’s order.

The shipping costs for the goods shall be borne by the Buyer, and the corresponding price information is displayed next to the shipping methods.

PRODUCT RETURNS

If the ordered product does not meet the Buyer’s expectations, they may return it to the Seller within 30 days from the receipt of the product or the notification of its arrival at the parcel machine.

Only clean, unused, and undamaged products will be accepted for return, which have not been used in a way other than what is necessary to ascertain the nature, features, and functioning of the goods, as is permitted for testing the goods in a physical store.

When returning a used product, the principle of reasonableness shall be followed, i.e., if the product had to be tried on to ascertain its suitability and the product packaging was opened carefully and without damaging it, the Product shall be considered unused.

If the returned product or its sales packaging is damaged, and the Buyer has used the product in a way other than what is necessary to ascertain the nature, features, and functioning of the product, or if the product shows signs of use or wear, the Seller reserves the right to reduce the refunded amount in accordance with the decrease in the value of the goods.

The product must be sent back to the Seller in its original packaging and together with all supplementary materials with which it was originally sent to the Buyer. The original packaging must always be opened carefully and without damaging the packaging.

The Buyer shall notify the Seller of the wish to return the product via the email address epood@velohunt.ee. If the reason for the return is a product defect or other similar circumstance, the Buyer shall notify the Seller, and an agreement will be made regarding the exchange of the defective product.

The Buyer shall return the product to the Seller via Shipit24, selecting the parcel machine of their choice located at Peetri Selver. The return can be processed HERE.

The transport costs associated with the return shall be borne by the Buyer, except if the product sent to the Buyer was damaged (which did not occur due to opening the packaging) or if the wrong product was mistakenly sent to the Buyer.

The refund will be executed as soon as possible, but no later than 14 days after the Seller has received the Buyer’s request for return. The money will not be refunded before the returned product reaches the Seller, so that the Seller can verify its condition.

If the Buyer has chosen a delivery method other than the cheapest delivery method offered by the e-store, the Seller is not obliged to refund the shipping cost that exceeds the cost associated with the standard delivery method.

RIGHT TO LODGE A COMPLAINT

Upon receiving the goods, the Buyer shall inspect all products and ensure that the quantity and features of the products correspond to the order. In the event of non-conformities, the Buyer shall notify the Seller within a reasonable time after they discovered or should have discovered the product’s non-conformity with the terms of the contract.

The Seller is responsible for the non-conformity or defect of the product sold to the Buyer, which existed at the moment the item was handed over and which becomes apparent within two years from the handover of the goods to the Buyer.

In the event of a defect, the Buyer has the right to contact the Seller and lodge a complaint within two months at the latest. To do so, an email can be sent to epood@velohunt.ee or a call can be made to (+372) 5333 2536.

The Seller is not responsible for defects that arose after the product was handed over due to the Buyer’s action or inaction (incorrect use, accident, etc.) or if it is a matter of natural wear caused by normal use of the product. The Seller is also not responsible for defects that arose due to not following the instructions indicated in the product manual or due to not performing maintenance.

If the purchased product has defects for which the Seller is responsible, the Seller shall repair or replace the defective product. If the product cannot be repaired or replaced, the Seller shall refund all fees associated with the sales contract to the Buyer.

The Seller shall respond to the complaint lodged by the Buyer in writing or in a form reproducible in writing within 15 days of receiving the complaint.

DISPUTE RESOLUTION

All disagreements between the Seller and the Buyer shall be resolved through mutual negotiation. The Buyer shall submit all complaints to the Seller either via the email address epood@velohunt.ee or by telephone (+372) 5333 2536.

If for any reason the disagreements cannot be resolved mutually, the Buyer has the opportunity to turn to the Consumer Disputes Committee (https://ttja.ee/tarbijavaidluste-komisjon). The Consumer Disputes Committee is competent to resolve disputes arising from contracts concluded between the Buyer and the e-store. The review of the Buyer’s complaint by the committee is free of charge.

In addition, the Buyer may turn to the European Union platform for resolving consumer disputes.
